Important Notice
By using JPX Gadget Tech, you agree to be legally bound by these Terms and Conditions. Please read them carefully before using our services. If you do not agree, do not use our Platform.
1. Acceptance of Terms
By accessing and using JPX Gadget Tech ("Platform", "Service", "we", "us", or "our"), you accept and agree to be bound by these Terms and Conditions ("Terms").
If you do not agree to these Terms, you must not use our Platform. Your continued use constitutes acceptance of any modifications to these Terms.
These Terms apply to all users, including browsers, buyers, sellers, and contributors of content.
2. User Accounts
Account Creation
- You must be at least 18 years old to create an account
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- You are responsible for all activities under your account
- One person or entity may maintain only one account
Account Termination
- You may close your account at any time through account settings
- We reserve the right to suspend or terminate accounts that violate these Terms
- Termination does not relieve you of obligations incurred before termination
- Upon termination, your right to use the Platform ceases immediately
3. Device Listing Requirements
Seller Obligations
- Provide accurate descriptions of device condition, specifications, and defects
- Upload clear, authentic photos that represent the actual device
- Set fair and competitive pricing in Malaysian Ringgit (RM)
- Respond to buyer inquiries within 48 hours
- Ship items within 3 business days of confirmed payment
- Remove listings immediately once items are sold
Prohibited Listings
- Stolen, counterfeit, or illegally obtained devices
- Devices with removed or tampered IMEIs
- Items subject to recalls or safety warnings
- Devices with outstanding financial obligations
- Non-functional devices not clearly marked as such
4. Transaction Process
Buyer Responsibilities
- Review device details and seller ratings carefully before purchase
- Complete payment through approved Platform methods only
- Inspect items upon delivery and report issues within 48 hours
- Communicate respectfully with sellers regarding concerns
- Leave honest feedback after transaction completion
Payment Processing
- All transactions processed through Stripe payment gateway
- Platform fee of 5% applied to each completed transaction
- Payments held in escrow until buyer confirms receipt
- Refunds processed within 5-7 business days when approved
- Currency conversions subject to real-time exchange rates
Shipping and Delivery
- Sellers must use tracked shipping methods
- Buyers responsible for shipping costs unless otherwise specified
- Delivery timeframes are estimates, not guarantees
- Risk of loss transfers to buyer upon delivery confirmation
- Claims for damaged or lost shipments must include tracking information
5. Prohibited Activities
You agree NOT to engage in any of the following:
Fraud, misrepresentation, or deceptive practices
Circumventing Platform fees or payment systems
Harassment, threats, or abusive behavior toward other users
Uploading malware, viruses, or harmful code
Scraping, data mining, or unauthorized access to Platform data
Creating multiple accounts to manipulate ratings or reviews
Using automated systems or bots without authorization
Infringing intellectual property rights of others
Posting offensive, illegal, or inappropriate content
Interfering with Platform operations or security measures
6. Intellectual Property Rights
Platform Content
- All Platform content, design, logos, and trademarks are owned by JPX Gadget Tech
- You may not copy, modify, distribute, or create derivative works without permission
- Unauthorized use may result in civil and criminal penalties
User Content
- You retain ownership of content you upload (photos, descriptions, reviews)
- You grant us a worldwide, non-exclusive license to use, display, and distribute your content
- You represent that you have rights to all content you post
- We may remove content that violates these Terms or applicable laws
7. Warranties and Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
We do not guarantee:
Uninterrupted or error-free service
Accuracy or completeness of Platform content
Security of data transmission
Compatibility with all devices or browsers
Achievement of specific results from Platform use
We are not responsible for:
Quality, safety, or legality of listed devices
Truth or accuracy of seller listings
Ability of sellers to complete transactions
Actions or inactions of Platform users
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JPX GADGET TECH SHALL NOT BE LIABLE FOR:
Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Damages arising from user errors, omissions, or violations
Third-party conduct or content on the Platform
Unauthorized access to or alteration of your data
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR RM100, WHICHEVER IS GREATER.
Some jurisdictions do not allow limitation of liability, so these limits may not apply to you.
9. Dispute Resolution
Internal Resolution
- Contact our support team at support@secondhandmobilehub.com for assistance
- We will attempt to mediate disputes between buyers and sellers
- Resolution process typically takes 7-14 business days
- Both parties must cooperate in good faith
Legal Proceedings
- Any disputes not resolved internally shall be subject to the exclusive jurisdiction of Malaysian courts
- These Terms are governed by the laws of Malaysia
- You waive any objection to venue in Malaysian courts
- Each party bears its own legal costs unless otherwise awarded
10. Indemnification
You agree to indemnify, defend, and hold harmless JPX Gadget Tech, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
Your violation of these Terms
Your violation of any laws or regulations
Your violation of third-party rights
Your use of the Platform
Content you post or transmit through the Platform
Transactions between you and other users
11. Modifications to Terms
We reserve the right to modify these Terms at any time.
Material changes will be notified via:
Email to registered users
Prominent notice on the Platform
Updated "Last Modified" date at the top of this page
Your continued use after modifications constitutes acceptance of the new Terms.
If you do not agree to modifications, you must discontinue Platform use.
12. Termination
Termination by User
- You may terminate your account at any time through account settings
- Termination does not excuse you from completing pending transactions
- You remain liable for any fees or charges incurred before termination
Termination by Platform
- We may suspend or terminate accounts immediately for Terms violations
- Grounds for termination include fraud, harassment, illegal activity, or repeated complaints
- We are not liable for damages resulting from account termination
- Terminated users may not create new accounts without permission
13. General Provisions
Entire Agreement
- These Terms constitute the entire agreement between you and JPX Gadget Tech
- Supersedes all prior agreements, understandings, and communications
Severability
- If any provision is found invalid or unenforceable, remaining provisions remain in effect
- Invalid provisions shall be replaced with valid provisions achieving similar economic effect
Waiver
- Failure to enforce any provision does not constitute a waiver
- Waiver of one breach does not waive subsequent breaches
Assignment
- You may not assign or transfer these Terms without our written consent
- We may assign these Terms to any successor or affiliate
